Smith v. State

District Court of Appeal of Florida, First District
Apr 14, 1997
691 So. 2d 1140 (Fla. Dist. Ct. App. 1997)

Opinion

Case No. 96-2062

Opinion filed April 14, 1997.

An appeal from the Circuit Court for Duval County, William Wilkes, Judge.

Nancy A. Daniels, Public Defender, and Nada M. Carey, Assistant Public Defender, Tallahassee, Attorneys for Appellant.

Robert A. Butterworth, Attorney General, and James W. Rogers, Assistant Attorney General, Tallahassee, Attorneys for Appellee.

We affirm the judgment and sentence in this Anders appeal, except for the assessment of $1500 for a public defender's lien. Appellant was not advised of his right to a hearing to contest the amount. The lien must be stricken without prejudice to reimpose it upon compliance with section 27.56, Florida Statutes, and Florida Rule of Criminal Procedure 3.720(d)(1).

Anders v. California, 386 U.S. 738 (1967).

AFFIRMED.

WEBSTER and LAWRENCE, JJ., CONCUR.
