JUDGMENT


The Court has signed its Order Accepting the Findings, Conclusions, Recommendation of the United States Magistrate Judge in this case. It is therefore ORDERED, ADJUDGED and DECREED that David Carfrey's Defendant's Motion to Dismiss or, Alternatively, Motion for Summary Judgment with Supporting Brief, filed November 26, 2004, and Defendant Georgia Carfrey's Motion to Dismiss or, Alternatively, Motion for Summary Judgment with Supporting Brief, filed January 7, 2005, are hereby GRANTED. Plaintiff's federal and state claims are DISMISSED without prejudice.

It is further ORDERED, ADJUDGED, and DECREED that the clerk shall transmit a true copy of this judgment and the order adopting the Findings and Recommendations of the United States Magistrate Judge to the parties.
