Wiggins v. State

District Court of Appeal of Florida, First District
May 13, 1994
636 So. 2d 202 (Fla. Dist. Ct. App. 1994)

Opinion

No. 92-3275.

May 13, 1994.

An Appeal from the Circuit Court for Escambia County; Joseph Q. Tarbuck, Judge.

Nancy A. Daniels, Public Defender, and Carl S. McGinnes, Asst. Public Defender, Tallahassee, for appellant.

Robert A. Butterworth, Atty. Gen., and James W. Rogers, Sr. Asst. Deputy Atty. Gen., Dept. of Legal Affairs, Tallahassee, for appellee.

We affirm appellant's judgment and sentence. However, we remand for the trial court to reconcile and correct discrepancies between the written judgment and sentence, the order of revocation, and the oral pronouncements at the revocation hearing. See Maddox v. State, 619 So.2d 473 (Fla. 1st DCA 1993); Williams v. State, 604 So.2d 8 (Fla. 1st DCA 1992).

BOOTH, WOLF and WEBSTER, JJ., concur.
