Walter v. Longo

District Court of Appeal of Florida, Second District
Jun 21, 2000
761 So. 2d 1174 (Fla. Dist. Ct. App. 2000)

Opinion

No. 2D99-1644.

Filed June 21, 2000.

Appeal from the Circuit Court for Pinellas County; Thomas E. Penick, Jr., Judge.

Richard P. Hirtreiter, St. Petersburg, for Appellant.

George M. Osborne, St. Petersburg, for Appellee.

Barbara Walter appeals the final summary judgment in this case. We affirm the judgment. Because there is no evidence in the record to support the award of attorney's fees, we reverse the trial court's award of fees and remand for a new hearing. See Clark v. Squire, Sanders Dempsey, 495 So.2d 264 (Fla. 3d DCA 1986).

Affirmed in part; reversed and remanded.

THREADGILL, A.C.J., and STRINGER, J., Concur.
