JUDGEMENT


In accordance with the Order entered this date, it is ORDERED, ADJUDGED, and DECREED that plaintiff's Motion To Remand Count One of the Complaint (for worker's compensation benefits) to the Circuit Court of Mobile County, Alabama, be and is hereby GRANTED. Plaintiffs Counts Two and Three of the Complaint shall remain under this court's jurisdiction.

The Clerk shall REMAND this action to the Circuit Court of Mobile County, Alabama. Each party to bear its own costs.

ORDER ADOPTING THE REPORT AND RECOMMENDATION OF THE MAGISTRATE JUDGE REGARDING REMAND COUNT ONE OF THE COMPLAINT

After due and proper consideration of all portions of this file deemed relevant to the issues raised, and there having been no objections filed, the Report and Recommendation of the Magistrate Judge made under 28 U.S.C. § 636(b)(1)(B) and dated August 24, 2000, is hereby ADOPTED as the opinion of this Court.

Accordingly, it is ORDERED that plaintiffs Motion To Remand be GRANTED, and that plaintiffs claim for worker's compensation benefits (Count One of the Complaint) be REMANDED to the Circuit Court of Mobile County, Alabama.

Plaintiff's Counts Two and Three of the Complaint shall remain under this court's jurisdiction. The Court DIRECTS the Clerk of Court to take all steps necessary to effectuate the remand.
