Velasquez v. Jones College

District Court of Appeal of Florida, Third District
Aug 4, 1999
738 So. 2d 1007 (Fla. Dist. Ct. App. 1999)

Opinion

No. 98-2119.

Opinion filed August 4, 1999. Rehearing Denied September 8, 1999.

An Appeal from the Circuit Court for Dade County, Steve Levine, Judge, L.T. No. 97-10290.

Robbins Reynolds, Marc J. Reynolds, Miami; and Arthur Joel Berger, Miami, for appellant.

Coll Davidson Smith Salter Barkett, and Ted C. Craig, Miami, for appellee.

Before SCHWARTZ, C.J., and NESBITT, and GODERICH, JJ.

Because the plaintiff's reliance on the allegedly false statements was unjustifiable in light of the clear and unambiguous disclaimer, we affirm the trial court's order granting final summary judgment in favor of the defendant. See Baker v. United Servs. Auto. Ass'n, 661 So.2d 128 (Fla. 1st DCA 1995), review denied, 669 So.2d 252 (Fla. 1996); Iden v. Kasden, 609 So.2d 54, 55 (Fla. 3d DCA 1992), review denied, 620 So.2d 761 (Fla. 1993).

Affirmed.
