ORDER GRANTING RELATOR'S SUPPLEMENTAL MOTION TO MODIFY 1997 PROTECTIVE ORDER


It is hereby ORDERED that

(1) The following sentence is stricken from the Protective Order in this case: "However, CONFIDENTIAL INFORMATION shall not be disclosed in any manner to the named Relator except as agreed upon by the parties /or by further order."

(2) The following language is to be incorporated into the Protective Order:

Relator Scott Pogue will not be provided access to any documents which either the Atlanta Physicians, HCA, or West Paces designate as "Confidential — Counsel Only." As agreed among the parties, those defendants agree to so designate only documents which contain current financial information.

(3) Defendant DTCA is ordered to pay Relator all reasonable attorneys' fees and costs incurred in preparing the Supplemental Motion to Modify 1997 Protective Order.

IT IS SO ORDERED.
