State v. Steinbrecher

District Court of Appeal of Florida, Third District
Feb 20, 1981
393 So. 2d 66 (Fla. Dist. Ct. App. 1981)

Opinion

No. 81-83.

February 3, 1981. Rehearing Denied February 20, 1981.

Petition from the Circuit Court, Dade County, Moie J.L. Tendrich, J.

Jim Smith, Atty. Gen. and Anthony C. Musto, Asst. Atty. Gen., for petitioner.

Jack Nageley, Miami Beach, for respondent.

Before SCHWARTZ, BASKIN and DANIEL S. PEARSON, JJ.

Although we are unaware of any authority to support the trial judge's ruling declining to limit polygraph testimony, and we do not approve his decision, we decline to entertain the state's petition for certiorari because review by certiorari of pre-trial evidentiary rulings appears inappropriate. Fla.R.App.P. 9.140(c).
