Opinion

No. 61598.

July 8, 1982.

Application for Review of the Decision of the District Court of Appeal — Direct Conflict of Decisions.

Jim Smith, Atty. Gen. and C. Michael Barnette, Asst. Atty. Gen., Daytona Beach, for petitioner.

James B. Gibson, Public Defender and Brynn G. Newton, Asst. Public Defender, Seventh Judicial Circuit, Daytona Beach, for respondent.

On March 31, 1982, this Court entered its Order accepting jurisdiction and dispensing with oral argument. We have now determined that the Court is without jurisdiction, and therefore the Petition for Review is denied, Fla.App., 411 So.2d 198.

It is so ordered.

ALDERMAN, C.J., and ADKINS, BOYD, OVERTON and McDONALD, JJ., concur.
