State v. Shuler

District Court of Appeal of Florida, Second District
Nov 19, 1993
627 So. 2d 75 (Fla. Dist. Ct. App. 1993)

Opinion

No. 93-00540.

November 19, 1993.

Appeal from the Circuit Court for Pasco County; Stanley R. Mills, Judge.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Ron Napolitano, Asst. Atty. Gen., Tampa, for appellant.

James Marion Moorman, Public Defender, and Robert D. Rosen, Asst. Public Defender, Bartow, for appellee.

The state appeals an order dismissing on double jeopardy grounds a felony charge of driving under the influence. This appeal is controlled by our opinion in State v. Coupal, 626 So.2d 1013, (Fla.2d DCA 1993). See also State v. Knowles, 625 So.2d 88, (Fla. 5th DCA 1993). Therefore, we reverse the trial court's order and remand for further proceedings consistent with Coupal.

CAMPBELL, A.C.J., and THREADGILL, J., concur.
