State v. Jackson

Supreme Court of Florida
Feb 6, 1986
482 So. 2d 345 (Fla. 1986)

Opinion

No. 66728.

February 6, 1986.

Application for Review of the Decision of the District Court of Appeal — Direct Conflict of Decision; Fifth District — Case No. 84-236.

Jim Smith, Atty. Gen. and W. Brian Bayly, Asst. Atty. Gen., Daytona Beach, for petitioner.

James B. Gibson, Public Defender and James R. Wulchak, Chief, Appellate Div., Asst. Public Defender, Seventh Judicial Circuit, Daytona Beach, for respondent.

On August 23, 1985, this Court entered its order accepting jurisdiction and dispensing with oral argument. We have now determined that the Court is without jurisdiction and, therefore, the petition for review is denied.

No motion for rehearing will be entertained by the Court.

It is so ordered.

BOYD, C.J., and ADKINS, OVERTON, McDONALD, EHRLICH, SHAW and BARKETT, JJ., concur.
