JOHNSON, J., dissents.


I dissent from the conclusion reached by the majority and would grant the Writ of Prohibition for the reasons and upon the authorities cited in the dissenting opinion filed by me in the companion case of State of Florida ex rel. Lowe v. Nelson, 202 So.2d 232.
