Affirmed on the authority of Massler v. Troy State University, 343 So.2d 1 (Ala. 1977); Ellison v. Abbott et al., 337 So.2d 756 (Ala. 1976); and Cox v. Board of Trustees of the University of Alabama, 161 Ala. 639, 49 So. 814 (1909).

AFFIRMED.

TORBERT, C.J., and BLOODWORTH, MADDOX, FAULKNER, ALMON, SHORES and EMBRY, JJ., concur.

JONES, J., dissents.


For the reasons as stated in my dissent in Ellison v. Abbott et al., supra, I respectfully dissent.
