Everett Edmon Spencer instituted a proceeding under the Post Conviction Procedure Act, and from a denial of relief, he applied for leave to appeal.

Petition dismissed.

Before BRUNE, C.J., and HENDERSON, HAMMOND, PRESCOTT and HORNEY, JJ.


The petition herein must be dismissed, as the applicant was released from custody on July 4, 1960, which fact renders the case moot. Noble v. Warden, 221 Md. 581, 155 A.2d 664.

Petition dismissed.
