538 So. 2d 54 (Fla. Dist. Ct. App. 1989)

Opinion

No. 87-2533.

January 6, 1989. Rehearing Denied February 15, 1989.

Appeal from the Circuit Court for Pinellas County; Thomas E. Penick, Jr., Judge.

James Marion Moorman, Public Defender, Bartow, and Allyn Giambalvo, Asst. Public Defender, Clearwater, for appellant.

David F. Pearce, pro se.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Peggy A. Quince, Asst. Atty. Gen., Tampa, for appellee.

We recognize that the conviction of a codefendant was vacated; however, there are distinguishing facts presented in this case. Accordingly, we affirm Pearce's convictions for trafficking in cocaine and possession of drug paraphernalia.

Elias v. State, 526 So.2d 1014 (Fla. 2d DCA 1988).

AFFIRMED.

CAMPBELL, C.J., and THREADGILL and PARKER, JJ., concur.
