Opinion

Case No. SC04-837.

May 23, 2005.

Lower Tribunal No. 2D03-1716.

Upon review of the response to this Court's order to show cause dated March 8, 2005, the Court has determined that it should decline to accept jurisdiction in this case. See Nesbitt v. State, 889 So. 2d 801 (Fla. 2004). The petition for discretionary review is, therefore, denied.

No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d).

PARIENTE, C.J., and WELLS, QUINCE, CANTERO and BELL, JJ., concur.
