Opinion

No. 2D13–5613.

Thomas James LUDWIG, Appellant / Petitioner(s), v. STATE of Florida, Appellee / Respondent(s).

Opinion

BY ORDER OF THE COURT.

Grounds one, two, and four of the petition alleging ineffective assistance are denied. We grant relief as to the claim raised in ground three of the petition. The circuit court shall strike the imposition of discretionary costs without prejudice to reimpose them after following the proper procedures. See Boyington v. State, 125 So.3d 327, 327–28 (Fla. 1st DCA 2013). This is the only relief to which the petitioner is entitled.

SILBERMAN, WALLACE, and BLACK, JJ., Concur.
