Opinion

No. 89-3136.

July 18, 1990.

Appeal from the Circuit Court for Broward County; Arthur J. Franza, Judge.

Richard L. Jorandby, Public Defender, and Joseph S. Shook, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and John M. Koenig, Jr., Asst. Atty. Gen., West Palm Beach, for appellee.

AFFIRMED. We reject appellant's contention that section 775.084(4)(e), Florida Statutes (1989), is facially unconstitutional. See King v. State, 557 So.2d 899 (Fla. 5th DCA 1990); See Roberts v. State, 559 So.2d 289 (Fla. 2d DCA 1990).

DOWNEY, POLEN and GARRETT, JJ., concur.
