KATCHER v. SANS SOUCI COMPANY

Supreme Court of Florida
Jan 28, 1969
217 So. 2d 297 (Fla. 1969)

Opinion

No. 36580.

November 20, 1968. Rehearing Denied January 28, 1969.

Writ of Certiorari to the District Court of Appeal, Third District.

Weintraub Weintraub, Miami, for petitioners.

Schwarz Cohen and Daniel Neal Heller, Miami, for respondent.

After argument and further study of the record and authorities cited it now appears there is no conflict, hence we have no jurisdiction. In fact the distinguishing facts in this case reveal the correctness of the judgment of the District Court of Appeal, 200 So.2d 826. Therefore, the writ should be discharged.

So ordered.

CALDWELL, C.J., ERVIN and ADAMS (Retired), JJ., and WALKER and POPPER, Circuit Judges, concur.

ROBERTS and DREW, JJ., dissent.
