Jimenez v. State

Supreme Court of Florida.
Oct 29, 2014
153 So. 3d 906 (Fla. 2014)

Opinion

No. SC13–1280.

10-29-2014

Jose Antonio JIMENEZ, Appellant(s), v. STATE of Florida, Appellee(s).

Opinion

Appellant, a prisoner under sentence of death, appeals the circuit court's summary denial of a successive motion for postconviction relief. We affirm. Neither Trevino v. Thaler, 133 S.Ct. 1911 (2013), nor Martinez v. Ryan, 132 S.Ct. 1309 (2012), grants Florida criminal defendants the right to challenge the effectiveness of trial counsel or present Brady v. Maryland, 373 U.S. 83 (1963), challenges in successive state postconviction proceedings based upon a claim of ineffective assistance of initial collateral counsel. See generally Howell v. State, 109 So.3d 763, 774 (Fla.2013) ; Zakrzewski v. State, 2014 WL 2810560, at *1 (Fla. June 20, 2014) (table opinion).

LABARGA, C.J., and PARIENTE, LEWIS, QUINCE, CANADY, POLSTON, and PERRY, JJ., concur.
