         Transferred to Court of Appeal, First District, with directions to vacate its decision and to reconsider the cause in light of Myers v. Philip Morris Companies, Inc.(2002) 28 Cal.4th 828, 123 Cal.Rptr.2d 40, 50 P.3d 751 and Naegele v. R.J. Reynolds Tobacco Co. (2002) 28 Cal.4th 856, 123 Cal.Rptr.2d 61, 50 P.3d 769. Appellant's motion to "transfer this case from 'Grant and Hold' Review to Active Review" filed August 28, 2002, is denied. Respondent's "Motion to Dismiss Review" filed September 6, 2002, is denied.
