Opinion

10 F.R.D. 146 (S.D. Iowa 1950) DULANSKY et al. v. IOWA-ILLINOIS GAS & ELECTRIC CO. et al. No. 1-15. United States District Court, S.D. Iowa, Davenport Division. February 21, 1950

Wrongful death action by Paul Dulansky, father of Gary Dulansky, deceased, and Bonnie Dulansky, administratrix of the estate of Gary Dulansky, deceased, against the Iowa-Illinois Gas & Electric Company and Tri-City Railway Company, arising out of alleged negligence of defendants' bus driver in colliding and striking plaintiffs' ten year old son. Plaintiffs filed a motion to require the defendant Iowa-Illinois Gas & Electric Company to produce certain documents under the federal rules. The District Court, Switzer, J., held that one paragraph of plaintiffs' motion showed sufficient good cause for production and inspection of a report made by bus driver to defendant concerning accident, which was in defendant's hands.

Motion sustained in part and overruled in part.
