       ORDER

       All five members of Department I of the Court considered the matters set on its September 7, 1995, Motion Calendar, the files herein and unanimously agreed that the following order be entered. Therefore, Chief Justice Barbara Durham directed that this order be entered:

       IT IS ORDERED:

       That the Respondent's motion to dismiss is denied and the Petition for Review is granted

only on the issues of (1) the expert witness fees and (2) the noncompetition agreement.
