In re: Philip Desormeaux applying for certiorari, or writ of review, to the Court of Appeal, Third Circuit, Parish of Acadia.


Writ denied. The result is correct.

SUMMERS, J., the writ should be granted.

TATE, J. Although the issue is correctly decided under existing jurisprudence, this court should re-examine Forcum-James Co., Inc. v. Duke Transportation Co., 231 La. 953, 93 So.2d 228 (1957) insofar as applicable to situations such as is here presented.
