Supreme Court of Florida
Mar 8, 2011
58 So. 3d 260 (Fla. 2011)

Opinion

Case No. SC10-1989.

March 8, 2011.

Lower Tribunal No(s). 2009-10138CF, 2009-10139CF, 2009-10140CF, 2009-10141CF, 2009-10142CF, 2009-10251CF, 2009-10252CF, 2010-00141CF.

The order to show cause issued by this Court on October 7, 2010, is hereby discharged.

However, because the petition, which was signed and filed by Jack White, on behalf of Misty Janette Croslin, does not comply with Florida Rule of Judicial Administration 2.515 and Florida Rule of Appellate Procedure 9.100(g), it is stricken as unauthorized. The case is hereby dismissed. See Durocher v. Singletary, 623 So. 2d 482, 485 (Fla. 1993) (stating "a next friend has the burden `to establish the propriety of his status and thereby justify the jurisdiction of the court'[;] . . . a `mere volunteer,' therefore, it has no standing as a next friend . . ."). Any motions or other requests for relief in this case are also denied.

PARIENTE, LEWIS, QUINCE, LABARGA, and PERRY, JJ., concur.
