ORDER (Motion to Withdraw — #54)


Before the Court is defendants' attorney Gregory F. Buhyoff's second Motion to Withdraw (#54, filed February 13, 2003) as counsel for the defendants. The first was denied because it was made on the eve of trial and would have left a corporate client without counsel. The circumstances have changed, however, and Court will grant the motion.

The defendants obtained out-of-state counsel, Melvin K. Silverman, to represent them. He was admitted pro hac vice. In addition, Mr. Andras F. Babero appeared as local counsel to assist Mr. Silverman in trying the case. Furthermore, defendant The New Las Vegas Development Company has been dismissed by stipulation of the parties. Thus, Mr. Buhyoff's presence is no longer necessary and he will be permitted to withdraw.

IT IS THEREFORE ORDERED that the Motion of Attorney Gregory F. Buhyoff, Esq. To Withdraw as Counsel of Record for Defendants Cyrus Milanian and the New Las Vegas Development Company (#54) is GRANTED.
