District Court of Appeal of Florida, Fifth District
Jun 13, 1997
695 So. 2d 506 (Fla. Dist. Ct. App. 1997)

Opinion

Case No. 96-2993

Opinion filed June 13, 1997.

Appeal from the Circuit Court for Brevard County, Tonya Rainwater, Judge.

James B. Gibson, Public Defender, and Kenneth Witts, Assistant Public Defender, Daytona Beach, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Maximillian J. Changus, Assistant Attorney General, Daytona Beach, for Appellee.

AFFIRMED. See Ferris v. State, 489 So.2d 174 (Fla. 5th DCA 1986) (holding that enough proof in a probation revocation proceeding is the greater weight of the evidence and not beyond a reasonable doubt).

GRIFFIN, THOMPSON and ANTOON, JJ., concur.
