Appeal from the order of the Court of Common Pleas of Lehigh County, No. 17, April Term, 1968, in case of Borough of Macungie v. Agnew R. Hoch.

Complaint charging defendant with violating Borough Ordinance in maintaining a nuisance. After conviction and sentence before a Justice of the Peace, defendant appealed. Appellant found not guilty, SCHEIRER, J. Borough appealed to the Commonwealth Court of Pennsylvania. Held: Affirmed on the Opinion of SCHEIRER, J., 34 Lehigh Law Journal 99 (1970).
