Reversed and remanded on the authority of Clift v. State, Ala., 352 So.2d 838 [released this date] and Colston v. State, Ala.Cr.App., 350 So.2d 337, 11 A.B.R. 1974 (1977). (For a recent United States Supreme Court holding on double jeopardy, see Harris v. Oklahoma, ___ U.S. ___, 97 S.Ct. 2912, 53 L.Ed.2d 1054 (1977), here distinguishable for the reasons set out in Clift and Colston.)

REVERSED AND REMANDED.

All the Justices concur.
