Opinion

No. 90-3037.

November 4, 1991.

An Appeal from the Circuit Court for Leon County; F.E. Steinmeyer, Judge.

Randy Baggett, pro se.

Robert A. Butterworth, Atty. Gen., Gypsy Bailey, Asst. Atty. Gen., Tallahassee, for appellee.

The summary denial of appellant's Fla. R.Crim.P. Rule 3.850 motion is affirmed as the motion does not contain the proper oath and is therefore facially insufficient. Scott v. State, 464 So.2d 1171 (Fla. 1985).

AFFIRMED.
